Prohibition of the price control mechanisms and disgorgement of the economic benefit

By decision of 4 February 2026 (B2-73/20) the Federal Cartel Office prohibited Amazon from influencing sellers' prices on the German Amazon Marketplace through its existing price control mechanisms, and set an initial partial amount of around EUR 59 million as disgorgement of the economic benefit. The authority relies on section 19a(2) and section 19 of the German Competition Act and Article 102 TFEU. The authority states that the decision is not yet final; Amazon may appeal to the Federal Court of Justice within one month.
